LYNC WEBSITE TERMS OF USE

These Terms apply to all products, programs, memberships, certifications,
subscriptions, websites, portals, digital platforms, educational offerings, coaching
services, communities, trainings, content, and related services provided by LYNC
Institute, LYNC Academy, Powered by LYNCTM, LYNC @Home, LYNC CommunitiesTM,
and affiliated entities (collectively, "LYNC").
By accessing or using any LYNC website or platform, you agree to be bound by these
Terms.
1. ELIGIBILITY
You must be at least eighteen (18) years of age to access or purchase services through
the Website.
If accessing services on behalf of an organization, you represent that you have authority
to bind that organization to these Terms.
2. EDUCATIONAL PURPOSES ONLY
The Website and all content are provided solely for educational, informational, training,
leadership development, and coaching purposes.
LYNC does not provide:
• Medical advice
• Mental health treatment
• Psychological services
• Counseling
• Therapy
• Legal advice
• Financial advice
• Clinical treatment
Nothing contained on the Website shall be interpreted as professional advice.
3. NO EMPLOYMENT OR PROFESSIONAL RELATIONSHIP
Nothing contained within the Website, materials, programs, services,
certifications, memberships, or communities shall be construed as creating an
employment relationship, agency relationship, partnership, joint venture,
therapist-client relationship, physician-patient relationship, attorney-client
relationship, fiduciary relationship, or other professional relationship between
LYNC and any user except as expressly established through a separate written
agreement.
4. INTELLECTUAL PROPERTY
All content appearing on the Website is owned exclusively by LYNC and protected
under United States copyright, trademark, and intellectual property laws.
Protected content includes:

• Curriculum
• Videos
• Downloads
• Graphics
• Documents
• Frameworks
• Assessments
• Training Materials
• Methodologies
• Logos
• Trademarks
No content may be copied, reproduced, distributed, sold, licensed, republished, or
modified without prior written consent.
4. PROHIBITED USES
Users may not:
• Share login credentials with unauthorized individuals;
• Attempt unauthorized access to LYNC systems or platforms;
• Reverse engineer software, systems, or technology;
• Scrape content, data, or materials;
• Distribute, reproduce, or misuse proprietary content;
• Upload malicious code, malware, ransomware, or other harmful software;
• Impersonate another person or organization;
• Violate applicable laws or regulations;
• Use LYNC materials, content, curriculum, recordings, frameworks, methodologies, or
intellectual property to train, develop, fine-tune, or improve artificial intelligence systems,
machine learning models, large language models, or similar technologies without prior
written authorization from LYNC.
5. USER SUBMISSIONS
Users retain ownership of content voluntarily submitted to LYNC.
By submitting comments, testimonials, reviews, surveys, forms, feedback, community
posts, social media content, communications, or other materials, users grant LYNC a
non-exclusive, worldwide, perpetual, royalty-free license to use, reproduce, modify,
display, publish, distribute, and utilize such materials for operational, educational, quality
assurance, training, marketing, promotional, and business purposes.
Nothing herein obligates LYNC to use submitted materials.
6. THIRD-PARTY SERVICES
LYNC may utilize third-party providers including learning management systems,
payment processors, video conferencing platforms, analytics services, and
communication platforms.
LYNC is not responsible for the actions, content, privacy practices, or performance of
third-party providers.
7. DISCLAIMER OF WARRANTIES
The Website and all content are provided "AS IS" and "AS AVAILABLE."
LYNC makes no guarantees regarding:
● Website availability;
● Platform uptime;
● Accuracy or completeness of information;
● Educational achievement;
● Outcomes or results.
LIMITATION OF LIABILITY
TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, LYNC SHALL NOT BE
LIABLE FOR ANY INDIRECT, INCIDENTAL, CONSEQUENTIAL, SPECIAL, EXEMPLARY,
PUNITIVE, EMOTIONAL, FINANCIAL, BUSINESS, OR LOST PROFIT DAMAGES ARISING
OUT OF OR RELATING TO THE USE OF ANY LYNC WEBSITE, PROGRAM, MEMBERSHIP,
CERTIFICATION, PRODUCT, SERVICE, COMMUNITY, OR CONTENT, EVEN IF LYNC HAS
BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.
IN NO EVENT SHALL LYNC'S TOTAL AGGREGATE LIABILITY ARISING OUT OF OR
RELATING TO ANY CLAIM, CAUSE OF ACTION, OR DISPUTE EXCEED THE LESSER OF:
• THE AMOUNT ACTUALLY PAID BY THE USER OR PARTICIPANT TO LYNC FOR THE
APPLICABLE PRODUCT, PROGRAM, MEMBERSHIP, OR SERVICE DURING THE TWELVE
(12) MONTHS IMMEDIATELY PRECEDING THE EVENT GIVING RISE TO THE CLAIM; OR
• ONE HUNDRED DOLLARS ($100.00).
SOME JURISDICTIONS DO NOT ALLOW THE EXCLUSION OR LIMITATION OF CERTAIN
DAMAGES. ACCORDINGLY, PORTIONS OF THIS SECTION MAY NOT APPLY TO CERTAIN
USERS TO THE EXTENT PROHIBITED BY APPLICABLE LAW.
9. INDEMNIFICATION
Users agree to indemnify and hold harmless LYNC, its officers, directors, employees,
contractors, affiliates, instructors, coaches, and representatives from any claims, losses,
damages, liabilities, costs, or expenses arising from use of the Website.
10. DISPUTE RESOLUTION
Any dispute shall first be submitted to mediation.
If mediation is unsuccessful, disputes shall be resolved through binding arbitration in
Wisconsin.
USERS KNOWINGLY AND VOLUNTARILY WAIVE THE RIGHT TO A JURY TRIAL.
11. CLASS ACTION WAIVER
Users agree to bring claims only in an individual capacity and waive participation in
class, collective, representative, or mass actions.
12. NO RELIANCE
Users acknowledge that they have not relied upon any oral statements, marketing
materials, projections, earnings claims, referral expectations, employment expectations,
testimonials, examples, or representations not expressly contained in these Terms or
any applicable program agreement.
13. GOVERNING LAW
These Terms shall be governed exclusively by the laws of the State of Wisconsin.
Venue shall be Outagamie County, Wisconsin.
13. MODIFICATIONS
LYNC reserves the right to update these Terms at any time.
Continued access to or use of LYNC services following publication of revised Terms
constitutes acceptance of such modifications.

Where applicable, clicking an acceptance box, enrolling in a program, making a
purchase, or continuing to use the Website constitutes your electronic signature and
agreement to these Terms.
