Terms of Use & Program Terms and Conditions

1. Acceptance of Terms
By checking the agreement box and proceeding with purchase, enrollment, or access to any LYNC program, you acknowledge and agree that:
You have read and understand this Agreement
You agree to be legally bound by its terms
This constitutes a legally binding electronic contract
You are at least 18 years of age
You have the authority to enter into this Agreement
2. Scope of Services
This Agreement applies to all LYNC Institute and LYNC Academy offerings, including but not limited to:
LYNC @Home
Memberships and subscriptions
Certification and training programs
Digital content, tools, and curriculum
Any associated products or services
3. No Medical or Clinical Services
LYNC provides educational, informational, and coaching-based content only.
LYNC does not:
Provide medical, psychological, or therapeutic services
Diagnose or treat any condition
Replace licensed professionals
You acknowledge and agree that:
You are solely responsible for your decisions and actions
You will seek licensed professional care when appropriate
4. LYNC @Home Certification Limitation
Completion of LYNC @Home:
Does not grant permission to teach, train, or certify others
Is intended for personal, non-commercial use only
You may not:
Sell or distribute LYNC materials
Represent yourself as a certified LYNC coach
Use materials for commercial purposes
5. Certification and Coach Status
If you pursue certification:
You remain an independent individual
You are not an employee, agent, or representative of LYNC
You may operate your own independent business
LYNC is not responsible for:
Your services
Your clients
Your business outcomes
Separate agreements apply for any contracted or placement roles.
6. Intellectual Property
All materials, including the LYNC Model of Care™, content, systems, and curriculum are proprietary.
You are granted a limited, non-transferable, revocable license for personal use only.
You may not:
Copy, reproduce, or distribute materials
Teach or resell content
Create derivative works
Violations may result in immediate termination and legal action.
7. Payments and Subscriptions
By purchasing any LYNC offering:
You agree to all pricing and billing terms
Subscriptions may automatically renew unless canceled
You authorize LYNC and its payment processors to charge your payment method
Failure to complete payment may result in suspension or termination of access.
8. Refund Policy
All purchases are final and non-refundable unless otherwise stated in writing and approved through LYNC Institute.
No refunds will be issued for:
Partial participation
Failure to complete a program
Change of mind
9. User Responsibilities
You agree to:
Use all content lawfully and ethically
Not misrepresent LYNC or its programs
Not harm, mislead, or exploit others
Not misuse or distribute proprietary materials
10. Disclaimer of Warranties
All services are provided:
“AS IS” and “AS AVAILABLE”
LYNC makes no guarantees regarding:
Results or outcomes
Business success
Personal or financial improvements
11. Limitation of Liability
To the fullest extent permitted by law:
LYNC shall not be liable for:
Indirect, incidental, or consequential damages
Loss of income or business opportunity
Personal, emotional, or professional outcomes
Maximum liability shall not exceed the lesser of:
The amount paid by you, or
$100
12. Indemnification
You agree to indemnify and hold harmless LYNC Institute and LYNC Academy from any claims, damages, or liabilities arising from:
Your actions or conduct
Your business activities
Your misuse of materials
13. Termination
LYNC reserves the right to suspend or terminate access for:
Violation of this Agreement
Misuse of materials
Non-payment
14. Governing Law
This Agreement shall be governed by the laws of the State of Wisconsin, without regard to conflict of law principles.
15. Privacy Policy
Your use of LYNC services is also governed by our Privacy Policy, which explains how your data is collected, used, and shared, including with authorized internal systems and service providers.
16. Modifications
LYNC reserves the right to update or modify this Agreement at any time.
Continued use of services constitutes acceptance of any updates.
