12. TEXT MESSAGING AND ELECTRONIC COMMUNICATIONS

By providing your email address, telephone number, mobile phone number, or other contact information to LYNC, you expressly consent to receive communications from LYNC, its affiliates, service providers, contractors, and authorized representatives regarding:

  • Program enrollment and participation;

  • Memberships and subscriptions;

  • Certifications and training activities;

  • Scheduling and appointment reminders;

  • Coaching and implementation services;

  • Account notifications;

  • Billing and payment matters;

  • Customer support;

  • Program updates;

  • Events, workshops, webinars, and educational opportunities;

  • Marketing, promotional, and informational communications where permitted by law.

Communications may be delivered through:

  • Email;

  • Telephone calls;

  • Text messages (SMS);

  • Automated or prerecorded messages where permitted by law;

  • Learning management systems;

  • Mobile applications;

You understand that consent to receive program-related communications is a condition of participation in certain LYNC services.

Consent to receive marketing communications is voluntary and may be withdrawn at any time by:

  • Following the unsubscribe instructions contained in the communication;

  • Replying STOP to applicable text messages;

Opting out of marketing communications will not prevent LYNC from sending transactional, operational, legal, account-related, billing-related, certification-related, safety-related, or program-related communications.

Message and data rates may apply depending on your mobile carrier and service plan.

LYNC is not responsible for delays, delivery failures, or charges imposed by telecommunications providers, internet service providers, or third-party communication platforms.

13. DATA STORAGE, PROCESSING, AND TRANSFERS

LYNC is committed to maintaining commercially reasonable administrative, technical, organizational, and physical safeguards designed to protect Personal Information from unauthorized access, disclosure, alteration, misuse, loss, or destruction.

LYNC utilizes reputable third-party service providers and technology platforms to support the operation of its programs, memberships, certifications, websites, educational services, payment processing, communications, data storage, and related business activities.

Security measures may include, where appropriate:

  • Access controls and authentication procedures;

  • Password-protected systems;

  • Secure payment processing through authorized payment providers;

  • Encrypted data transmission where supported by service providers;

  • Secure cloud-based storage solutions;

  • Monitoring and administrative safeguards designed to protect information.

Despite reasonable security measures, no method of internet transmission, electronic storage, cloud computing environment, software platform, communication network, or information security program can be guaranteed to be completely secure.

Accordingly, LYNC does not warrant or guarantee that information, systems, networks, communications, or data transmissions will be free from unauthorized access, cyberattacks, security incidents, service interruptions, system failures, malware, ransomware, data loss, or other security-related events.

By accessing or using LYNC Services, you acknowledge and accept the inherent risks associated with electronic communications, internet-based services, cloud computing technologies, and digital data storage.

LYNC relies upon independent third-party service providers for various business functions. While LYNC makes reasonable efforts to select reputable providers, LYNC is not responsible for the independent security practices, security failures, service interruptions, outages, or data breaches of third-party providers except to the extent required by applicable law.

In the event LYNC becomes aware of a data breach involving Personal Information under its control, LYNC will comply with applicable federal, state, and local notification requirements.

Nothing in this Privacy Policy shall be construed as creating a guarantee of security, a guarantee against unauthorized access, or an obligation exceeding those imposed by applicable law.

13A. USER SECURITY RESPONSIBILITIES

Users are responsible for maintaining the confidentiality of their account credentials, passwords, devices, and access information.

Users agree to promptly notify LYNC of any suspected unauthorized access, account compromise, security incident, or misuse of their account.

LYNC shall not be responsible for losses arising from a user's failure to safeguard account credentials or from unauthorized access resulting from the actions or omissions of the user.

LYNC is not responsible for third-party platforms or integrations.

You are responsible for reviewing their policies.

15. HEALTH DISCLAIMER

LYNC provides educational and coaching services only.

We do not provide medical or mental health treatment and do not replace licensed professionals.

16. CHILDREN’S PRIVACY

Services are not intended for individuals under 18 without appropriate consent.

17. EDUCATIONAL, STUDENT, FAMILY, AND PROGRAM INFORMATION

Certain LYNC programs, memberships, certifications, trainings, coaching services, educational offerings, and community initiatives may involve information relating to students, children, families, parents, guardians, educators, schools, community organizations, coaches, participants, and other individuals involved in the delivery or participation of LYNC services.

Information provided to LYNC may be received directly from:

  • Participants;

  • Parents or legal guardians;

  • Schools or educational institutions;

  • Community organizations;

  • Referral sources;

  • Authorized representatives;

  • Coaches, advisors, trainers, consultants, or contractors;

  • Third-party service providers authorized by the participant.

Such information may include:

  • Contact information;

  • Enrollment information;

  • Program participation records;

  • Educational information;

  • Certification and training records;

  • Attendance information;

  • Progress and completion records;

  • Communications and correspondence;

  • Forms, applications, surveys, and assessments;

  • Documents voluntarily submitted by participants or authorized representatives.

LYNC uses such information solely for legitimate educational, operational, administrative, certification, coaching, training, community support, program management, quality assurance, compliance, safety, reporting, and business purposes.

LYNC does not knowingly collect information directly from children under the age of eighteen (18) without the involvement, authorization, or consent of a parent, guardian, school, educational institution, authorized representative, or other legally authorized individual where required by applicable law.

Where applicable, LYNC will make commercially reasonable efforts to handle educational, student, and family information in accordance with contractual obligations, applicable privacy requirements, and industry-standard confidentiality practices.

Participants, parents, guardians, schools, organizations, coaches, and authorized representatives are responsible for ensuring that any information provided to LYNC is accurate and that they possess the necessary authority or consent to provide such information.

Nothing contained in this Privacy Policy shall be construed as creating a student-school relationship, educational records custodian relationship, healthcare provider relationship, therapist-client relationship, or any legal duty beyond those required by applicable law and contractual obligations.

We may update this Privacy Policy at any time.

Continued use of the Services after updates constitutes acceptance of the revised Policy.

19. ELECTRONIC COMMUNICATIONS CONSENT

LYNC will make commercially reasonable efforts to honor such requests on a prospective basis only and cannot guarantee removal of content already published or distributed.
