LYNC @HOME MEMBERSHIP AGREEMENT

PLEASE READ THIS AGREEMENT CAREFULLY.
BY CHECKING THE ACCEPTANCE BOX, PURCHASING, ENROLLING IN, ACCESSING, OR
PARTICIPATING IN LYNC @HOME, YOU ACKNOWLEDGE THAT YOU HAVE READ,
UNDERSTAND, AND AGREE TO BE LEGALLY BOUND BY THIS AGREEMENT.
THIS AGREEMENT CONSTITUTES A LEGALLY BINDING CONTRACT BETWEEN YOU
("PARTICIPANT," "MEMBER," OR "USER") AND LYNC INSTITUTE, LYNC ACADEMY, AND
THEIR AFFILIATED ENTITIES (COLLECTIVELY, "LYNC").
1. PROGRAM DESCRIPTION
LYNC @Home is an educational, personal development, and family support membership
program designed to provide participants with access to educational content, resources,
workshops, tools, coaching-based guidance, community support opportunities, and related
learning experiences.
2. PROGRAM MODIFICATIONS
LYNC reserves the right to modify, enhance, replace, update, add, remove, or discontinue
curriculum, educational content, training materials, technology platforms, membership features,
community offerings, schedules, resources, benefits, and related program components from
time to time.
LYNC may make such modifications to improve program quality, enhance participant
experience, address operational needs, comply with legal requirements, incorporate new
educational materials, or support organizational growth.
Such modifications shall not materially reduce the membership term purchased by Participant or
materially alter fees already paid for the applicable enrollment period.
Participant acknowledges that access methods, technology platforms, community features,
educational materials, and program components may evolve over time and that such changes
do not constitute grounds for cancellation, refund, chargeback, or termination of payment
obligations.
3. ELIGIBILITY
To participate in LYNC @Home:
You must be at least eighteen (18) years of age.
You must have legal authority to enter into this Agreement.
You must provide accurate enrollment information.
Parents or legal guardians enrolling minors are responsible for the minor's participation and
compliance with this Agreement.
4. EDUCATIONAL PURPOSE ONLY
LYNC @Home is an educational and coaching-based program.
LYNC does not provide:
Medical treatment
Mental health treatment
Psychological services
Counseling
Therapy
Crisis intervention
Legal advice
Financial advice
Clinical services
Participation in LYNC@Home does not create a therapist-client, physician-patient,
counselor-client, or other professional treatment relationship.
Participants are solely responsible for decisions made based on program content.
5. NO GUARANTEE OF RESULTS
Individual outcomes vary significantly.
LYNC makes no guarantee regarding:
Personal growth
Emotional improvement
Family outcomes
Relationship outcomes
Parenting outcomes
Educational outcomes
Health outcomes
Financial outcomes
Any testimonials, examples, success stories, or participant experiences are illustrative only and
do not guarantee future results.
6. MEMBERSHIP TERM
The initial LYNC@Home membership includes three (3) months of access for the enrollment fee
published at the time of purchase.
Upon completion of the initial membership term, Participant may be offered the opportunity to
continue membership through the LYNC @Home Continuation Program.
Enrollment into the Continuation Program is optional and requires Participant's affirmative
consent.
If Participant elects to enroll in the Continuation Program:
Membership shall continue on a month-to-month basis.
The current continuation fee is $9.99 per month.
Membership shall automatically renew each month until canceled.
Participant authorizes recurring monthly billing using the payment method on file.
LYNC reserves the right to modify continuation pricing upon advance notice as required by
applicable law.
7. PAYMENT AUTHORIZATION
By enrolling in LYNC @Home and any continuation subscription, Participant authorizes LYNC
and its designated payment processors to charge all applicable enrollment fees, subscription
fees, renewal fees, taxes, and authorized charges to the payment method provided.
Participant is responsible for maintaining accurate and current billing information.
Failure to process payment may result in suspension or termination of membership access.
8. REFUND POLICY
ALL SALES ARE FINAL.
No refunds shall be provided for:
Initial LYNC@Home enrollment fees
Continuation subscription fees
Partial months of service
Failure to participate
Failure to complete the program
Voluntary withdrawal
Change of mind
Scheduling conflicts
Dissatisfaction with results
Lack of use of the program
Continuation Membership Cancellation
Participants may cancel their continuation membership at any time.
Cancellation will stop future recurring billing.
Cancellation does not entitle Participant to:
A refund of previously paid fees
A prorated refund
A partial month refund
A credit for unused time
Participant shall retain access through the end of the paid billing period unless otherwise stated
by LYNC.
All fees paid prior to cancellation are non-refundable.
9. CHARGEBACKS AND PAYMENT DISPUTES
Participant agrees not to initiate a chargeback or payment dispute for valid charges.
If a chargeback or payment dispute occurs:
Access may be immediately suspended.
Membership may be terminated.
Outstanding balances shall remain due.
Participant shall be responsible for any collection costs, administrative fees, chargeback fees, court costs, and reasonable attorney fees incurred by LYNC.
10. PERSONAL USE ONLY
LYNC@Home is licensed solely for the personal use of the enrolled participant and members of
their immediate household.
Participants may not:
Share login credentials
Share access with non-household members
Copy materials
Download content for redistribution
Resell content
Teach LYNC materials
Create derivative works
Use content for commercial purposes
11. CERTIFICATION RESTRICTIONS
Participation in or completion of LYNC @Home:
Does not create certification status.
Does not grant teaching rights.
Does not authorize training of others.
Does not create professional credentials.
Does not authorize representation as a Certified Powered by LYNC Coach.
Any unauthorized representation may result in legal action.
12. INTELLECTUAL PROPERTY
All LYNC @Home materials remain the exclusive property of LYNC.
Protected materials include:
LYNC Model of CareTM
Videos
Workbooks
Assessments
Frameworks
Graphics
Downloads
Recordings
Curriculum
Exercises
Training Materials
Participants receive a limited, revocable, non-transferable license solely for personal use during
authorized access periods.
13. COMMUNITY STANDARDS
Participants agree to:
Interact respectfully with others.
Refrain from harassment, discrimination, threats, or abusive conduct.
Respect confidentiality of fellow participants.
Refrain from disruptive behavior.
LYNC may remove any participant whose conduct negatively impacts the community.
14. PRIVACY
Participant information shall be handled in accordance with the LYNC Privacy Policy.
15. DISCLAIMER OF WARRANTIES
LYNC @Home is provided "AS IS" and "AS AVAILABLE."
LYNC disclaims all warranties, express or implied.
16. LIMITATION OF LIABILITY
To the fullest extent permitted by law:
LYNC shall not be liable for indirect, incidental, special, consequential, emotional, financial,
educational, health-related, or personal damages.
LYNC's maximum liability shall not exceed the amount paid by Participant for the applicable
membership.
17. INDEMNIFICATION
Participant agrees to indemnify and hold harmless LYNC, its officers, owners, employees,
contractors, affiliates, instructors, coaches, and representatives from claims arising from
Participant's conduct, misuse of materials, violation of law, or breach of this Agreement.
19. TERMINATION
LYNC reserves the right to suspend or terminate access for:
Violation of this Agreement
Misuse of materials
Non-payment
Fraudulent activity
Harmful conduct
Termination shall not create any refund obligation.
20. FORCE MAJEURE
LYNC shall not be liable for delays, interruptions, service disruptions, or failures in performance
resulting from causes beyond its reasonable control, including natural disasters, public health
emergencies, governmental actions, labor disputes, internet outages, technology failures, cyber
incidents, utility interruptions, or failures of third-party service providers.
21. DISPUTE RESOLUTION
Any dispute arising under this Agreement shall first be submitted to mediation.
If unresolved, the dispute shall be resolved exclusively through binding arbitration in Wisconsin
under the rules of the American Arbitration Association.
22. CLASS ACTION WAIVER
Participant agrees that all claims shall be brought solely in an individual capacity.
Participant waives participation in any class action, collective action, representative action, or
mass arbitration.
23. GOVERNING LAW
This Agreement shall be governed exclusively by the laws of the State of Wisconsin.
Venue for any permitted court action shall be Outagamie County, Wisconsin.
24. SEVERABILITY
If any provision of this Agreement is determined to be unenforceable, the remaining provisions
shall remain in full force and effect.
25. SURVIVAL CLAUSE
The provisions relating to payment obligations, intellectual property, confidentiality,
indemnification, media releases, dispute resolution, arbitration, class action waiver, and
limitation of liability shall survive termination of this Agreement.
26. ENTIRE AGREEMENT
This Agreement constitutes the complete agreement between Participant and LYNC regarding
LYNC @Home participation.
27. NO RELIANCE
Participant acknowledges that they have not relied upon any oral statements, marketing
materials, projections, testimonials, examples, success stories, representations, or expectations
not expressly contained in this Agreement.
Participant understands that individual experiences vary and that no guarantees regarding
outcomes, results, personal growth, family outcomes, educational outcomes, financial
outcomes, or other benefits have been made by LYNC.
28. ELECTRONIC SIGNATURE
By checking the acceptance box and enrolling in LYNC @Home, Participant acknowledges and
agrees that such acceptance constitutes a legally binding electronic signature with the same
force and effect as a handwritten signature.
29. MEDIA RELEASE, TESTIMONIAL CONSENT, AND RECORDING AUTHORIZATION
Participant understands and acknowledges that LYNC programs may include live workshops,
webinars, virtual meetings, group coaching sessions, certification programs, educational events,
community discussions, podcasts, interviews, video conferences, and other recorded activities.
Participant grants LYNC, its affiliates, successors, assigns, licensees, and representatives the
irrevocable right and permission to:
● Record Participant's voice, image, likeness, appearance, statements, comments,
participation, and testimonials;
● Photograph Participant;
● Create audio and video recordings;
● Use Participant's name, first name, professional title, business name, city, state, and
approved biographical information;
● Use written testimonials, survey responses, reviews, comments, social media posts, and
success stories submitted by Participant.
Participant authorizes LYNC to use such materials for:
Marketing and advertising;
Social media content;
Educational materials;
Training programs;
Website content;
Promotional campaigns;
Print materials;
Public relations;
Business development;
Internal training;
Future products and services.
Participant understands that such materials may be edited, reproduced, distributed, displayed,
published, transmitted, or otherwise used by LYNC in any format now known or later developed.
Participant waives any right to inspect or approve final materials.
Participant understands that no royalties, compensation, ownership rights, or future payments
shall be owed for such use.
Participant releases and forever discharges LYNC from any claims arising from the authorized
use of such materials, including claims relating to privacy, publicity rights, defamation, emotional
distress, or copyright ownership.
If Participant does not wish to participate in testimonials, photographs, or marketing-related
recordings, Participant must provide written notice to LYNC before participation in the applicable
event or program. LYNC will make commercially reasonable efforts to honor such requests
where practical; however, Participant understands that incidental inclusion in group recordings,

BY CHECKING THE ACCEPTANCE BOX, I ACKNOWLEDGE THAT I HAVE READ,
UNDERSTAND, AND AGREE TO THIS LYNC @HOME MEMBERSHIP AGREEMENT, THE
WEBSITE TERMS OF USE, THE PRIVACY POLICY, AND ALL RELATED PROGRAM TERMS.
